Welcome to Balmee Beauty! These Terms of Use (Terms) apply when you visit or purchase from our website www.balmeebeauty.com (Website).
By using our Website, you agree to these Terms and our Privacy Policy and Cookies Policy. If you don’t agree, please do not use the Website.
1. Using Our Website
You agree to use the Website lawfully and not to:

Engage in any activity that’s unlawful, harmful, or disruptive;

Introduce malware, spam, or harmful code.
You must be at least 18 years old (or have parental consent if you are under 18) to make purchases. Parents or guardians are responsible for any use of this Website by a minor under their care.
We may limit or cancel orders at our discretion, including where multiple orders use the same account, payment method, or address.
2. Products & Availability
We sell physical beauty and retail products only. We do our best to keep product descriptions, pricing and stock information accurate, but minor variations may occur. We may change or discontinue products or offers at any time without notice.
3. Orders & Payments
Orders are accepted and become binding contracts once payment is processed and you receive a confirmation email.
We accept payments through Shopify, PayPal, Afterpay, Shop App and other options shown at checkout. All prices are in Australian dollars (AUD) unless stated otherwise and include GST where applicable. You authorise us (and our payment providers) to charge your chosen payment method for the total amount, including any applicable delivery fees and taxes. We may apply card surcharges where permitted by law.
4. Shipping & Delivery
Our Shipping & Delivery Policy applies to all orders. By placing an order, you agree to the terms set out in that policy, including delivery times, costs, risk transfer and any applicable customs or import duties for international orders.
5. Changes, Cancellations & Returns
Before dispatch: Orders may only be cancelled before confirmation. Once confirmed, they are usually processed immediately and can’t be changed or cancelled.
Change of mind: Because our products are personal care items, we can’t accept returns or offer refunds for change of mind.
Faulty, damaged, or incorrect items: If your order arrives damaged, defective, or incorrect, email hello@balmeebeauty.com within 14 days with your order number and a photo. If your request is approved, we’ll provide return instructions and offer a replacement, store credit, or refund.
Third-party purchases: Returns of items purchased from other retailers are governed by that retailer’s policy.
Nothing in this section limits your rights under the Australian Consumer Law (ACL). If a product is faulty, doesn’t match the description, or is unfit for purpose, you are entitled to a repair, replacement, or refund.
6. Promotions, Gift Cards & Discounts
Promotions or discounts may have separate terms or expiry dates. We may modify or withdraw offers at any time.
7. Social Media & User Content
We love seeing your Balmee moments. By tagging or mentioning @balmeebeauty or using our name, hashtags, or handles in content, you grant us a royalty-free, worldwide licence to use, repost, or share that content across our website, social media, or marketing materials.
You confirm you own the rights to your content and that sharing it won’t infringe anyone else’s rights. If you prefer we don’t repost your content, email hello@balmeebeauty.com and we’ll remove it where practical.
8. Intellectual Property
All content on this Website, including text, graphics, images, videos, product designs, branding and logos (Content), is the property of Balmee Beauty Pty Ltd or used under licence. You may view and make a temporary copy of the Content for personal, non-commercial use only.
You must not copy, reproduce, adapt, transmit, display, publish, perform, or create derivative works from any Content for commercial purposes without our written permission.
Where we allow sharing of Content on social media or other platforms, that is subject to these Terms and your compliance with applicable platform rules.
9. Email & SMS Communication
By providing your email or phone number, you consent to receive promotional emails or SMS messages from Balmee regarding products, offers, promotions, or other marketing. You can unsubscribe at any time via the links provided in each communication.
We do not share your details with unrelated third parties for marketing purposes.
10. Disclaimer & Warranties
We make reasonable efforts to ensure that information on the Website is accurate and current. However, we do not guarantee that all information is complete, up-to-date, or error-free. Your use of this information is at your own risk.
All materials on this Website and any products purchased are provided “as is” and “as available”, without warranties of any kind, including merchantability, fitness for purpose, or non-infringement, to the extent permitted by law.
Nothing in these Terms limits your rights under the Australian Consumer Law. We do not guarantee that the Website, servers, or third-party services are free from viruses, malware, or harmful components.
11. Limitation of Liability
To the extent permitted by law: (a) Balmee is not liable for any loss or damage of any kind arising from your use of this Website, its content, or any products purchased, including indirect, incidental, special, or consequential losses (for example, lost profits, business interruption, or loss of data). (b) Where a law implies a warranty or condition into these Terms which cannot be excluded, our liability for breach of that warranty or condition is, at our option:

to repair or replace the goods or services; or

to pay the cost of having the goods or services supplied, repaired, or replaced.
Nothing in this clause limits your rights under the Australian Consumer Law.
11.1 To the fullest extent permitted by law, our liability for any loss or damage arising from your use of this Website or our products is limited to:

Resupplying, repairing, or replacing the goods or services; or

Paying the cost of resupplying, repairing, or replacing them.
11.2 We are not liable for indirect, incidental, special, or consequential losses, including lost profits, loss of business, or loss of data, except where the law does not allow this limitation.

To the extent permitted by law, you agree to indemnify and hold Balmee harmless from any claims, losses, damages, liabilities, costs, or expenses arising from: (a) your unlawful use of the Website; or

Nothing in this clause limits your rights under the Australian Consumer Law.
13. Privacy & Security
Your personal information is handled in accordance with our Privacy Policy and Cookies Policy. We use Shopify’s secure payment platform and implement reasonable measures to protect your data but cannot guarantee absolute security.
14. Third-Party Links & Services
This Website may contain links to third-party websites. Balmee does not control, endorse, or guarantee the accuracy, completeness, or quality of any content on third-party sites. Use of such websites is entirely at your own risk and third-party terms and privacy policies may apply. We encourage you to read them before using those websites.
15. Termination & Survival
Balmee may suspend or terminate your access to the Website or Services at any time if you breach these Terms. Any obligations or rights accrued prior to termination will survive.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia and any disputes will be resolved in the courts of that State.
17. Entire Agreement
These Terms, together with our Privacy Policy, Cookies Policy and Shipping and Returns Policy, constitute the entire agreement between you and Balmee regarding your use of this Website. Failure by Balmee to enforce any right or provision does not constitute a waiver of that right.

Soft Summer Instagram Giveaway — Terms & Conditions
1. Promoter
The promoter is Balmee Beauty Pty Ltd (ABN 59 676 430 621), in collaboration with Bronte Bodycare and K Juliet.
2. Eligibility

Open to Australian and New Zealand residents aged 18 years and over.

Employees, contractors, and immediate family members of the participating brands are not eligible to enter.

The giveaway is run via Instagram only.
3. Giveaway Period

The giveaway opens Saturday 3 January 2026 (AEDT).

Entries close midnight, Friday 9 January 2026 (AEDT).

The winner will be announced on Monday 12 January 2026 via @balmeebeauty’s Instagram account.
4. How to Enter
To enter, participants must:

5. Prize
One winner will receive the following prize pack (total value $311 AUD):

6. Winner Selection

7. General Conditions

This giveaway is not sponsored, endorsed, or administered by Instagram, and Instagram is released from any responsibility by each entrant.
